Welcome to DIY AI: Marketing™ (“Company,” “we,” “our,” or “us”). These Terms and Conditions govern your access to and use of our website, course materials, digital downloads, and any related services or communications. By enrolling in the DIY AI: Marketing program or accessing any associated content, you agree to be bound by these Terms.

Disclaimers and Educational Use

DIY AI: Marketing™ is an educational program designed to teach small business owners and creators how to strategically build, refine, and use custom GPTs for marketing purposes.

• This course provides training, frameworks, and examples based on professional experience.
• Kelly Sparks is not a lawyer, financial advisor, or compliance specialist, and the course does not offer legal, financial, or regulatory advice.
• Any AI tools, prompts, strategies, or workflows provided are for informational and educational purposes.
• Results vary based on individual effort, business context, data quality, and how AI is implemented.
  
  

You are responsible for reviewing, editing, and approving all AI-generated content before using it publicly or commercially.

We are not responsible for any inaccuracies, misunderstandings, or unintended outcomes resulting from AI-generated materials.

2. No Guarantee of Results

We do not guarantee:

• revenue growth,
• client acquisition,
• marketing results,
• or specific performance outcomes.
  
  

Your success depends on factors outside our control, including your business model, level of implementation, and industry conditions.

This applies to all course components, including the DIY AI: Marketing™ Companion “Coach Crystal” GPT and any downloadable assets or templates.

3. User Conduct and Appropriate Use

By using our materials, you agree to:

• use everything for lawful, personal, or business-internal purposes only;
• respect the intellectual property rights of Kelly Sparks and VMG Studios;
• refrain from sharing or distributing course login details or materials with others.
  
  

You are strictly prohibited from:

• copying, reselling, or redistributing course materials, templates, or downloads;
• repackaging AI-generated content or course frameworks as your own products, templates, or services for resale;
• training your own commercial GPTs using our materials for resale;
• uploading confidential or regulated information into AI tools.
  
  

We reserve the right to revoke access to the course for violations of these Terms.

4. Fees & Payment Terms

By purchasing DIY AI: Marketing™ GPT, you agree to the following:

Payment

• You may pay in full or via an installment plan if offered.
• For installment plans, you authorize automatic charges to your selected payment method.
  
  

Commitment

• You are responsible for completing all installments, regardless of course completion or withdrawal.
• Failure to complete payments may result in revoked access.
  
  

Delinquent Accounts

• Unpaid balances may be sent to collections.
  
  

5. Course Access

Purchasing DIY AI: Marketing™ grants you:

• lifetime access to the course and downloadable assets (lifetime = the operational lifespan of the program),
• access to updates and improvements at no additional cost,
• access to the DIY AI: Marketing™ Companion Coach GPT while the tool is publicly available.
  
  

Access is for individual use only and may not be shared, transferred, or sold.

If the program is ever discontinued, you will receive at least 60 days notice.

We reserve the right to revoke access for misuse or violation of these Terms.

6. AI Course Access & Restrictions

You may use the strategies and materials to build AI assistants for your own business.

You may NOT:

• resell, redistribute, or publish course materials, prompts, templates, or GPT configurations;
• sell pre-built GPTs or AI templates that rely substantially on this course;
• use the course content to create competing educational products or AI programs.
  
  

AI-generated content created through your custom GPT is yours to use; however:

• It must not be packaged as a product derived from our intellectual property.
  
  

7. Refund Policy

Due to the digital nature of the course and the immediate availability of course materials upon purchase, we do not offer voluntary refunds once access has been granted, except where required by applicable law. This covers: 

• DIY AI: Marketing™ 
• The DIY AI: Marketing™ Companion “Coach Crystal” GPT
• Any add-on resources or upgrades
  
  

8. Intellectual Property

All course materials, including videos, PDFs, templates, AI prompts, downloadable guides, and associated content, are owned by Kelly Sparks and VMG Studios and are protected under copyright law.

You are granted a personal, non-transferable license to use the materials for your own learning and business marketing.

You may not:

• copy, modify, distribute, or publicly share course content;
• use materials to train commercial AI tools or programs for resale;
  
  
• claim authorship of materials or redistribute them as templates or products.
  
  

Violations may result in legal action.

9. Privacy and Data Use

Your enrollment and website use are subject to our Privacy Policy, including how your information may be collected, used, or shared.

We do not require or encourage uploading sensitive, confidential, or regulated information into any AI services.

10. Third-Party Tools & Links

Our course may reference or integrate third-party tools, including OpenAI’s GPT platform. We are not responsible for:

• third-party functionality,
• privacy practices, or
• service availability.
  
  

Please review those providers’ terms before use.

11. Limitation of Liability

To the fullest extent permitted by law, Kelly Sparks, VMG Studios, and all affiliates are not liable for:

• inaccuracies or errors in course materials or AI-generated content,
  
• business losses or lost profits,
• indirect, incidental, or consequential damages,
• issues arising from third-party tools (including OpenAI).
  
  

By using this course, you agree to indemnify and hold harmless Kelly Sparks and VMG Studios from claims arising from your use of the course or any AI-generated outputs.

12. Modifications to Terms

We may update or modify these Terms at any time. Updated terms will be posted on this page. Continued use of the course or materials constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
